The law firm Pellerano & Herrera held a webinar titled “From the Statute to the Courtroom: Strategies, Challenges, and Opportunities under the New Criminal Procedure Code,” an analytical forum that addressed the key amendments introduced by Law No. 97-25 and their impact on criminal practice in the Dominican Republic.

The event, broadcast live through the firm’s YouTube channel, brought together litigators, legal advisors, academics, and members of the legal community interested in understanding the practical scope of the reform and its strategic implications.

The panel featured Pedro Balbuena, constitutional lawyer; Manuel Rodríguez, trial attorney; and Pellerano & Herrera attorneys Lucy Objío and Jean Paul Suárez, who analyzed the key developments introduced by the new procedural framework.

During his remarks, Mr. Rodríguez underscored the importance of the role of legal practitioners in the effective implementation of the new regime, noting:

“The effectiveness and proper application of this framework largely depend on the legal approach adopted by the system’s operators in applying these provisions. This reform must be understood and implemented as a true system of guarantees, aimed at strengthening the protection of fundamental rights within criminal proceedings.”

For his part, Mr. Balbuena highlighted the significance of this moment for the legal community, stating:

“We are at a pivotal stage for the Dominican criminal justice system. The dissemination and understanding of this reform are essential to ensuring its proper implementation, as the Criminal Procedure Code evolves to respond to societal needs and constitutional mandates.”

During the webinar, the panelists discussed the enhanced oversight of the reasonable time requirement, the reform’s impact on litigation strategies, and the need for greater planning from the early stages of criminal proceedings.

The session also included an interactive Q&A segment, allowing participants to explore the practical implications of the reform in greater depth, reflecting the high level of interest generated by this legislative update.

Law No. 97-25 introduces amendments to Law No. 76-02, which enacted the Dominican Criminal Procedure Code, with the aim of strengthening procedural guarantees, promoting a more efficient justice system, and aligning the framework with constitutional principles and recent jurisprudential developments.
